This Privacy Policy defines the procedure of collection, processing and storage of information, providing the personal data of the User, which the online store www.fromitalyonline.com can receive when the latter uses the services provided by the online store.

2. GENERAL

2.1 The use of www.fromitalyonline.com Services by the User means that s/he accepts this Privacy Policy and the terms of collection, processing and storage of the User's personal data.

2.2 The User must stop using the online store services when s/he does not accept the terms of the Privacy Policy.

5. PERSONAL DATA PROCESSING METHODS AND TERMS

5.1 The User’s personal data shall be processed without limitation of the term, in any legitimate way, including in information systems of the personal data with or without the use of automation means.

5.2 The User agrees that the Operator shall be entitled to transfer the personal data to the third parties, in particular, to the goods delivery services, solely for the purpose of fulfilling the User's order placed in the online store www.fromitalyonline.com

5.3 The User’s personal data may be transferred to the authorized governmental bodies only on the grounds and in accordance with the procedure established by law.

5.4 The Operator shall inform the User about the loss or disclosure of his/her personal data, if any.

6. PARTIES’ OBLIGATIONS

6.1 The User shall: 6.1.1. provide the personal data required to fulfill his/her order in the online store. 6.1.2. update and supplement the provided personal data in the event of changes in such information. 6.2. The Operator shall: 6.2.1. use the data obtained for the purposes specified in para. 4 hereof only. 6.2.2 ensure the privacy of confidential information, not disclose the same without the User’s prior consent in writing, as well as not to sell, exchange, publish, or disclose the personal data of the User otherwise, except for paragraphs 2.2, 5.2 and 5.3 hereof. 6.2.3 take precautions to protect the privacy of the User's personal data according to the procedure customary for the protection of such information in the existing business turnover. 6.2.4 block the personal data related to the relevant User from the moment of application or request of the User or his/her legal representative or authorized body for protection of personal data subjects' rights during the investigation period, when unreliable personal data or illegal actions are revealed.

7. PARTIES’ LIABILITY

7.1 The Operator, who failed to perform its obligations, shall be liable for the losses incurred by the User in connection with illegal use of his/her personal data as provided for by the law, except for the cases provided for in paragraphs 5.2, 5.3 and 7.2 hereof.

7.2 The Operator shall not be liable in case of loss or disclosure of Confidential Information, provided that such confidential information:

7.2.1. became accessible to the public before it was lost or disclosed.

7.2.2. was received from a third party before it was disclosed to the Operator by the User.

7.2.3. was disclosed subject to the User’s consent.

8. ARBITRATION

8.1 Prior to filing a lawsuit related to the relationship between the online store User and the Operator to the court, it is mandatory to submit a claim (a proposal in writing for voluntary dispute resolution).

8.2 The claim recipient shall notify the plaintiff in writing of the claim consideration results within 30 calendar days upon receipt of the claim.

8.3 In the event of failure to reach an agreement, the dispute shall be referred to a competent court in accordance with applicable laws.

8.4 This Privacy Policy and the relationship between the User and the Operator shall be governed by applicable laws of the plaintiff’s country.

9. MISCELLANEOUS

9.1 The Operator shall be entitled to amend this Privacy Policy without the User's consent.

9.2 The new Privacy Policy shall become effective since it is posted on the website of the online store, unless otherwise provided for by the new version of the Privacy Policy.
